A televíziós műsorok továbbközvetítése nem fair use – Röviden és tömören: már hogyan is lehetett volna?

„Fox filed suit against TVEyes for copyright infringement after TVEyes, a media company that continuously records the audiovisual content of more than 1,400 television and radio channels, enabled its clients to watch Fox’s programming. The Second Circuit held that TVEyes’s actions were not protected by the fair use doctrine. The court explained that, although TVEyes’s re‐distribution of Fox’s content served a transformative purpose by enabling clients to isolate material and to access it in a conventional manner, such re‐distribution makes available to clients virtually all of Fox’s copyrighted content that clients wish to see and hear. Therefore, TVEyes deprived Fox of revenue that properly belongs to the copyright holder. The court reversed the district court’s order to the extent that it found fair use; affirmed the district court’s order to the extent that it denied TVEyes’s request for additional relief; and remanded for entry of a revised injunction.”

Spanski Enterprises v. Telewizja Polska – Jogsértő lehet-e, ha egy lengyel televízió egy filmsorozat epizódjait feltölti a honlapjára, és amerikai végfelhasználók számára lehívásra hozzáférhetővé teszi azokat? A washingtoni szövetségi fellebbviteli fórum szerint igen, és az epizódonkénti 60.000 dolláros kártérítés is rendben van.

„Where a foreign broadcaster uploads copyrighted content to its website and directs that content onto a computer screen in the United States at a user’s request, the broadcaster commits an actionable domestic violation of the Copyright Act. The D.C. Circuit agreed with the district court’s finding, based on supportable factual findings, that TV Polska was liable for infringing Spanski’s copyrights in fifty-one episodes of certain Polish-language television programs that TV Polska transmitted into the United States via its online video-on-demand system, and concluded that damages of $60,000 per episode were appropriate in light of the circumstances. Therefore, the court affirmed the district court’s judgment as to both liability and damages.”

Vorschaubilder III – A német BGH két kiemelkedően fontos digitális szerzői jogi ítélete volt a Vorschaubilder I és II, amelyek egyaránt a Google képkereső-szolgáltatása keretében miniatürizált fényképek (ún. thumbnailek – ennek német párja a Vorschaubilder) lehívásra hozzáférhetővé tételének szerzői jogi megítélését tárgyalta. A sorozat harmadik elemében egy másik cég keresőmotorja képezte a vita tárgyát, amely azonban végső soron ugyancsak a Google találati eredményeit vetítette ki a végfelhasználó számítógépén. A BGH ítélete már csak azért is fontos, mert ebben elismerésre került a GS Media ügyben alkalmazott felelősségi koncepció (haszonszerzési vs. non-profit, és az ebből folyó tudati oldal), ráadásul ezúttal az alperesnek kedvező módon. A BGH szerint ugyanis az alperest nem terhelheti olyan általános ellenőrzési kötelezettség, hogy meggyőződjön a Google összes találati eredményének a jogszerűségéről. Más szóval, ha valaki a Google linkjeit osztja tovább, akkor – legalábbis Németországban – mentesül a szerzői jogi felelősség alól. A fenti linkről Jan Bernd Nordemann elemzése érhető el, de a lelkesebbje elolvashatja az ítéletet a GRUR folyóirat februári számában is (p. 178-189.). Nekem tetszett az anyag.

Egy kis pornó, szerzői jog és a DMCA – Épp a texasi konferencián hallottam oly sokat a Motherless ügyről. Akkor nagyon friss ítélet volt, íme a tartalmi összefoglalója:

„The Ninth Circuit affirmed the district court’s summary judgment for defendants and its order denying attorneys’ fees in a copyright case alleging infringement of pornographic content. The panel held that the Digital Millennium Copyright Act’s safe harbor applied to defendants because the material at issue was stored at the direction of the users and defendants did not have actual or apparent knowledge that the clips were infringing. Furthermore, defendants expeditiously removed the infringing material once they received actual or red flag notice of the infringement, they did not receive financial benefit, and they had a policy to exclude repeat infringers. Finally, the district court did not abuse its discretion in not exercising supplemental jurisdiction over a California state law claim, and the district court did not abuse its discretion in denying an award of attorneys’ fees to defendants.”

Másodfokon is elvérzett a Blurred Lines – Pedig szerintem már első fokon is rossz ítélet született. Meglátjuk, hogy mi lesz az eljárás további mente (az Egyesült Államokban mindig vannak eljárásjogi meglepetések), de a jelen állás szerint Marvin Gaye örököseinek az igénye Robin Thicke-kel és társaival szemben megalapozott volt. Az ítéletet egyébként rövidesen valamelyik bloggerünk le fogja elemezni.

„These consolidated appeals stemmed from a jury’s finding that Pharrell Williams, Robin Thicke, and Clifford Harris, Jr.’s song „Blurred Lines,” the world’s bestselling single in 2013, infringed Frankie Christian Gaye, Nona Marvisa Gaye, and Marvin Gaye III’s copyright in Marvin Gaye’s 1977 hit song „Got To Give It Up.” The Ninth Circuit affirmed in part and reversed in part the district court’s judgment. The panel held that „Got To Give It Up” was entitled to broad copyright protection because musical compositions were not confined to a narrow range of expression; the panel accepted, without deciding, the merits of the district court’s ruling that the scope of defendants’ copyright was limited, under the Copyright Act of 1909, to the sheet music deposited with the Copyright Office, and did not extend to sound recordings; the district court’s order denying summary judgment was not reviewable after a full trial on the merits; the district court did not err in denying a new trial; the district court did not abuse its discretion in admitting portions of expert testimony; the verdict was not against the clear weight of the evidence; the awards of actual damages and profits and the district court’s running royalty were proper; the district court erred in overturning the jury’s general verdict in favor of Harris and the Interscope Parties; the district court did not abuse its discretion in denying the Gayes’ motion for attorney’s fees; and the district court did not abuse its discretion in apportioning costs among the parties.”
